Terms of use.

These terms are an agreement between you and AnglerDash Limited ("AnglerDash", "we", "us"), a New Zealand company. They apply when you use the AnglerDash mobile app or this website. By creating an account or using AnglerDash, you accept them. If you do not accept them, please do not use AnglerDash.

How we handle your personal information is set out separately in our privacy policy, which forms part of these terms.

Read this first

Two things matter more than anything else in this document, so they are here at the top rather than buried:

• AnglerDash is a planning tool, not a safety system. Forecasts in the app are not a navigational aid and are no substitute for official marine weather forecasts and warnings, or for your own judgement on the day.
• Fishing rules are your responsibility. AnglerDash does not tell you what you are allowed to catch. Size limits, bag limits, seasons, closures and licence requirements are set by the relevant fisheries authority, and complying with them is on you.

Both are explained further below.

Using AnglerDash

Who can use it

You must be at least 13 years old to create an account. If you are under 18, you should have a parent or guardian's permission. You must be able to form a binding contract, and you must not be barred from using the service under any applicable law.

Your account

You can sign in with Google or with an email address and password. You are responsible for keeping your sign-in details secure and for what happens under your account. Tell us promptly through our support page if you think someone else has access to your account.

You choose a username, which is public and appears on any catch you share. Usernames must be unique. You may not choose one that impersonates someone else, that infringes a trade mark, or that is offensive — we can reclaim a username in those cases.

One account per person. Do not share your account, and do not create an account on someone else's behalf without their authority.

Your content

Your spots, catches, notes, gear and photos are yours. Recording them in AnglerDash does not transfer ownership to us, and we do not claim any rights over your fishing data beyond what is needed to run the service.

To provide AnglerDash, you grant us a non-exclusive, worldwide, royalty-free licence to store, copy, back up and display your content — but only for the purpose of operating the service and showing your content back to you. If you choose to make a catch public, that licence extends to displaying that catch and its photos to other users in the community feed, in the form described in our privacy policy.

That licence lasts only as long as you keep the content in AnglerDash. Delete a spot, a catch or a photo and the licence ends with it, other than for copies held in routine backups until they age out.

You are responsible for the content you upload. By uploading it you confirm you have the right to do so, and that it does not infringe anyone else's rights.

Sharing catches publicly

Every catch is private by default. Making a catch public is a deliberate choice, and you can reverse it at any time — though anything already published may have been seen or saved by others in the meantime.

Public catches are shown by fishing region, never at the spot where you caught the fish. That is a deliberate design decision, not a setting, and it applies to everyone.

Community rules

When using AnglerDash, and particularly when posting publicly, you must not:

• post content that is unlawful, abusive, harassing, hateful, obscene or deliberately misleading
• post someone else's photos or content as your own, or infringe anyone's intellectual property
• post another person's private information, including anyone else's fishing spots
• impersonate another person, or misrepresent your association with anyone
• use AnglerDash to advertise, spam or run a commercial operation without our written agreement
• record or promote fishing activity that breaks the law
• attempt to access other users' data, interfere with the service, probe or bypass its security, or place unreasonable load on it
• scrape, bulk-download or republish content from AnglerDash, or use it to build a competing dataset or product
• reverse engineer the app or its APIs, except to the extent the law expressly permits

Content we can remove

We may remove content that breaks these rules, and we may suspend or close an account that does so repeatedly or seriously. Where it is reasonable to do so, we will tell you why. We are not obliged to monitor everything posted, and removing some content does not mean we have reviewed all of it.

If you see something in the community feed that breaks these rules, report it to us through our support page and we will review it.

Forecasts, conditions and ratings

AnglerDash shows weather, marine, tide and solunar information, and ratings built on top of it, to help you decide when and where to fish. All of it is provided for planning purposes only.

• It is not a navigational aid and must not be relied on for navigation or for decisions about whether it is safe to go out. Always check the official marine weather forecast and any warnings in force for your area.
• Forecast data comes from third-party sources. We ingest it for a grid of locations and match your spot to the nearest point on that grid, so conditions shown for a spot are modelled and interpolated, not measured at the spot itself.
• Forecasts can be wrong, delayed, incomplete or unavailable — including through faults at a data source that are outside our control. Tide predictions are astronomical predictions and do not account for weather effects on actual water level.
• Ratings and insights are our own interpretation of the data. They are an opinion about fishing conditions, not a prediction of what you will catch, and no result is promised.

Fishing rules and regulations

AnglerDash does not provide regulatory advice and does not tell you whether a fish may lawfully be taken. Species information in the app is there to help you identify and log what you catch — nothing more.

Size limits, bag limits, seasonal closures, restricted areas, method restrictions and any licence or permit requirements are set by the relevant fisheries authority and can change. You are responsible for knowing and complying with the rules that apply where and when you fish, and for checking them with the authority rather than with us.

Safety on the water

Fishing, boating and being near water carry real risk. Decisions about whether to go out, where to go, and when to come back are yours alone, and remain yours regardless of anything AnglerDash shows you. Take proper safety equipment, tell someone your plans, and use your own judgement about conditions.

Availability and changes to the app

We aim to keep AnglerDash running well, but we do not promise it will be available without interruption or free of faults. We may need to suspend it for maintenance, and parts of it depend on third-party services and on your device having a connection.

We may add, change or remove features as the app develops. If we discontinue a feature you rely on, or the service as a whole, we will give reasonable notice where we can and a way to retrieve your content.

Free and premium features

AnglerDash offers free and premium features. Any paid features, their price and their subscription terms will always be shown before you purchase them.

Purchases are made through the Apple App Store or Google Play, not directly from us. That means your purchase is also subject to the store's terms, the store takes the payment, and refunds are handled by the store rather than by us. If you want a refund, request it through the store you bought from. Contact us anyway if something has gone wrong — we would rather know.

Where a paid feature is sold as a subscription, it renews automatically at the end of each period until you cancel it. You cancel in your Apple or Google account settings, and cancelling takes effect at the end of the period you have already paid for. If we change the price of a subscription, we will tell you before the change takes effect and you will have the chance to cancel.

If your premium access ends, whether because you cancel or because a payment fails, your data stays intact — you keep access to your spots, catches and photos, and premium features stop being available.

Our rights

AnglerDash — including the app, this website, our name, logo, and the ratings, insights and data models behind the forecasts — belongs to us or our licensors. These terms give you a personal, limited, non-transferable right to use the app for your own fishing. They do not give you any rights in our intellectual property.

Liability

Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986, or any other rights that cannot lawfully be excluded. If you use AnglerDash for business purposes, you agree that the Consumer Guarantees Act does not apply.

Subject to that, and to the fullest extent the law allows:

• AnglerDash is provided "as is". We do not warrant that forecasts, conditions, ratings or species information are accurate, complete or current.
• We are not liable for loss, injury, damage or cost arising from your reliance on information in the app, from decisions you make about going fishing, or from anything that happens on the water.
• We are not liable for indirect or consequential loss, or for lost profits, lost opportunity or lost data.
• Where we are liable despite the above, our total liability is limited to the greater of the amount you have paid for AnglerDash in the previous twelve months, or NZ$100.

Ending these terms

You can stop using AnglerDash at any time, and can ask us to close your account and delete your data as described in our privacy policy.

We may suspend or close your account if you break these terms, if we are required to by law, or if we discontinue the service. Except where the breach is serious, we will give you notice and a chance to put it right first. The sections covering your content licence for anything still published, our rights, liability and governing law survive the end of these terms.

Changes to these terms

We will update these terms as AnglerDash changes. The date at the top shows when they were last revised. If a change materially affects your rights, we will tell you in the app or by email before it takes effect. Continuing to use AnglerDash after that means you accept the updated terms.

General

These terms, together with the privacy policy, are the entire agreement between us about AnglerDash. If any part of them is found to be unenforceable, the rest continues to apply. If we do not enforce a term straight away, we have not given up the right to enforce it later. You may not transfer your rights under these terms; we may transfer ours if AnglerDash is sold or reorganised, provided your rights are not reduced.

Governing law

These terms are governed by New Zealand law, and the New Zealand courts have non-exclusive jurisdiction over any dispute about them. If you have a problem, please contact us first — most things are resolved faster that way.
